Georgia Native Americans Overview

Georgia has a rich Native American heritage, with several tribes historically inhabiting the region. While there are no federally recognized tribes currently residing entirely within Georgia, the state acknowledges several state-recognized tribes. Among these are the United Cherokee Indian Council of Georgia, the Eastern Cherokee Indian Tribe of Georgia, and the Georgia-Cherokee Indian Tribe. These groups comprise individuals of Cherokee descent who maintain cultural practices, advocate for preserving their heritage, and foster a sense of community through education and support initiatives. Additionally, Georgia recognizes several other groups and organizations that identify as Native American tribes, each with their own unique heritage and cultural practices.

Historically, before European colonization and the subsequent forced removals in the 19th century, Georgia was home to several prominent Native American tribes. The Cherokee were among the largest and most influential tribes in the Southeastern United States, playing a central role in Georgia’s history, especially during European settlement and the Trail of Tears. The Muscogee (Creek) were another significant tribe, vital to the region’s history and similarly subjected to forced relocation to Oklahoma during the Trail of Tears. The Seminole, originally part of the Creek Confederacy, migrated into Florida and parts of Georgia during conflict and displacement. The Yamasee were a powerful tribe in the early 18th century, involved in trade and conflicts with European settlers before many were displaced or assimilated into other tribes. Additionally, the Timucua inhabited parts of northern Georgia and were among the earliest Native American groups encountered by Spanish explorers.

In modern-day Georgia, while there are no federally recognized tribes within its borders, many Native Americans of Cherokee, Muscogee (Creek), and other ancestries continue to live in the state. These communities actively work to preserve their cultural traditions, languages, and heritage through various cultural centers, educational programs, and community events. Federal recognition is a legal status that affirms a tribe’s sovereignty and eligibility for specific federal programs. In contrast, though significant, state recognition does not confer the same legal status or benefits. Efforts continue among various groups in Georgia to seek federal recognition.

HUD 184 Mortgage Program Background and Purpose

The Section 184 Indian Home Loan Guarantee Program was created by the Housing and Community Development Act of 1992 to address the lack of mortgage lending in Indian Country. Native American homeownership has historically been an underserved market. Land held in trust for a tribe cannot be mortgaged, and land held in trust for an individual must receive approval from the Bureau of Indian Affairs (BIA), before a lien is placed on the property. Without the ability to mortgage and foreclose on a home or place a lien on individual trust property, lenders have found it difficult to make home loans to individual Native Americans.

Working with an expanding network of private sector and tribal partners, the Section 184 Indian Home Loan Guarantee Program endeavors to increase access to capital for Native Americans and provide private funding opportunities for tribal housing agencies with the Section 184 Indian Home Loan Guarantee Program. The program has grown to include eligible areas, determined by participating tribes, across the country. The Section 184 Indian Home Loan Guarantee Program is a home mortgage specifically designed for American Indian and Alaska Native families, Alaska Villages, Tribes, or Tribally Designated Housing Entities.

Under the provisions of Section 184 of the Housing and Community Development Act of 1992 and as amended under the provisions of the Native American Housing Assistance and Self-Determination Act of 1996, the U.S. Department of Housing and Urban Development (HUD) was authorized to guarantee loans made by private lenders to Native Americans, IHAs/TDHEs and tribes. The loan guarantee program is intended to increase the availability of mortgage lending on Indian reservations or designated Indian operating areas.
